Election Day is here, and Americans have more ways than ever to follow the money behind the 2026 midterm elections.

If you're thinking about putting a few dollars on Senate control, a competitive House race, or another political outcome, there's one question worth answering first: Can you trade election odds where you live?

Kalshi and Polymarket US offer prediction markets, but availability isn't quite the same across the country. Some states restrict certain event contracts, others are involved in ongoing legal disputes, and some sign-up promotions have their own eligibility rules.

Here's a state-by-state breakdown of the reported restrictions, how Kalshi and Polymarket compare, and what to check before creating an account.

Can I trade on the 2026 midterm elections in my state?

Election prediction markets are accessible in much of the United States, but important exceptions remain.

Kalshi faces court-ordered restrictions on election contracts in Nevada and Washington. Other states have restricted sports markets or challenged prediction market operators without necessarily blocking political contracts.

According to the latest availability information provided for this guide, the Polymarket US app is available in every state except Nevada and Utah.

That means your location matters, but so does the kind of contract you're trying to trade. Being able to open an account or claim a bonus doesn't necessarily mean every election market is accessible.

Where can you trade election odds on Kalshi?

Kalshi is a prediction market exchange regulated by the Commodity Futures Trading Commission (CFTC). It lets eligible users buy and sell event contracts tied to real-world outcomes, including U.S. elections.

For the 2026 midterms, Kalshi's election markets include:

  • Senate control: Which party will control the U.S. Senate?
  • House control: Which party will control the House of Representatives?
  • Congress balance of power: Which parties will control the two chambers?
  • Individual Senate races: Contracts covering particular state elections.
  • Governor and House races: Additional election contracts where listed.

Kalshi's major election-contract exceptions are Nevada and Washington, where applicable court orders restrict access.

Other states present more complicated circumstances. Michigan, for example, has restricted sports event contracts, but those restrictions do not automatically prohibit political contracts. States including Connecticut, New York, Ohio, and Tennessee have also faced regulatory challenges.

Kalshi Promo Code: MAX60

New Kalshi customers in qualifying jurisdictions can use the MAX60 promo code to access a $60 trading-credit offer after meeting the promotion's requirements.

Kalshi Welcome Offer Details
Promo code MAX60
Bonus $60 trading credit
Initial deposit requirement $10
Qualifying trading requirement $25
Minimum age 18

The bonus is not immediately withdrawable cash. You must use it according to Kalshi's promotional rules, and it may expire if unused.

Importantly, the offer's geographic eligibility does not, by itself, establish that a particular election contract is available.

Where is Polymarket US available for midterm election trading?

Polymarket is another major name in prediction markets, offering contracts connected to politics, economics, sports and other current events.

For American users, one distinction is essential: Polymarket US and the international Polymarket.com website are separate products.

The U.S. app has its own accounts, availability requirements and market offerings. American residents cannot simply use the international website to get around domestic restrictions.

Under the updated availability information supplied for this article, the Polymarket US app is accessible in 48 states, excluding Nevada and Utah. Washington and Michigan are included in the U.S. app's availability list.

However, general app availability doesn't guarantee access to every election contract. Readers should check the political markets currently listed in their version of the app.

Polymarket Promo Code: COVERS

Eligible new Polymarket US customers can use the COVERS promo code for a $25 trading-credit offer after making a qualifying $10 deposit.

Why Do Some States Restrict Election Prediction Markets?

The legal debate comes down to an important question: Are election prediction contracts federally regulated financial instruments, state-regulated gambling products, or subject to elements of both regulatory frameworks?

Kalshi and Polymarket operate within federal commodities regulation. However, some states argue that contracts involving elections, sports or other events violate their gambling laws.

That disagreement has led to lawsuits, regulatory enforcement, and court-ordered restrictions.

Nevada

Nevada has taken a restrictive approach to prediction markets. Kalshi faces court-ordered restrictions covering election contracts, while the Polymarket US app is unavailable under the supplied state list.

Washington

Kalshi election contracts face court-ordered restrictions in Washington. The updated information lists the Polymarket US app as available, although users should separately verify access to political contracts and any applicable restrictions.

Michigan

Michigan has restricted certain sports event contracts. This does not automatically mean that Senate, House or other election contracts are prohibited.

Utah

Utah has also challenged prediction market activity under state gambling law. Check Kalshi's platform and promotional availability against any applicable restrictions on individual contracts.

Polymarket is unavailable in Utah.

Other States With Ongoing Disputes

States including Connecticut, New York, Ohio, Tennessee, Illinois and Wisconsin have raised regulatory or legal questions involving prediction markets.

But an ongoing dispute isn't necessarily an active ban. Users should distinguish between a lawsuit, a restriction on one contract category, and an operator-wide prohibition.

What midterm election markets can you trade?

You don't need to follow every congressional district to understand the available options.

Prediction market platforms list contracts on several recognizable outcomes:

Election Market What You're Trading On
Senate control Which party controls the Senate after the election
House control Which party controls the House after the election
Congress balance of power The combination of parties controlling Congress
Individual Senate races The winner of a specific Senate election
Governor races The winner of a gubernatorial election
House district races The winner of an individual congressional contest

Not all of these contracts will necessarily be available on both platforms or in every jurisdiction.
