Legal experts say accidental misplacements of documents aren't necessarily crimes. The cases prosecuted tend to be intentional violations. Unlike Biden, Trump has no good defense. Court is likely to deny his claims of executive privilege and classification of documents. Problem with classifying defense is that (1) more than a dozen ex-white house staffers say it's false, and (2) law says it doesn't matter if documents are classified or not. Government has enough evidences to prove Trump knowingly failed to return all documents.

Wrong ... biden does not have vp privileges... those documents don't belong in his possession. He is president now, documents now he can hold, classify,declassify... that his executive privilege. Trump has few years to classify, declassify. Trump was secured. Will be interesting to see whats in bidens garage.
