Can Someone Please Give Me The Right Answer.

Please don't answer this unless you are 100% sure and can show me where to find it. I have asked 20 people and 15 say one thing and 5 say another. Here is the breakdown.

 

Late in a tournament I have pocket 3's vs A10. Board comes all 5 spades including the 2 of spades. I have the 3 of spades the other guy has no spades. So we both have the same top 4 cards K spade J spade 7 spade and 4 spade, my 5 card is 3 of spades and his is 2 of spades. The dealer said it was a spilt pot, but don't I have the better hand? I said I have the better flush but he said the chop. What is the rule on that?

Ya I have been playing poker for 30 years. I knew I was right but it was just a charity thing for fun so I let it go. People had their 13 and 14 year old kids playing so it was not the time to make a scene. Most people told me I was wrong it would be a split pot but I disagree. Can you show me something in writing about this situation? Thanks.

you win the pot, your 3 of spades beats the deuce. It's pretty simple. But since it was for charity the dealer obviously wasn't prefessional so who cares? But you are right, and anyone that tells you it was a chop, well you want to play with idiots like that.

you definately win, I have played with a few retards who SWEAR that same situation is a split pot. Best 5 cards and your 3 would be higher then his 2 that was on the board. At least it was charity though, in the casino and we are calling FLOOOOOOR

Some dealers get confused on chops, or 2 pair boards when one player has the ace and you have a pocket pair that beats a pair on the board, like I have 9 9 , board is J 8 8 2 2 , the dealer says 2 pair with the ace, I'm like wait a minute, I have  a higher 2 pair. It is understandable to miss this , noone is perfect, you really have to be aware on kickers and stuff. If they get it righ that's all you can ask for.

some dealers work such long hours and into the late nights and are like zombies. they hardly pay attention so something like that could happen.
