And for those that say her rights were violated - do you really know for sure that she did not break some sort of law by doing what she did (i.e. videotaping and then not listening to the cops)? Are we really sure that there is not some sort of law that she broke (I do not know the answer)? There are all kind of bullshit laws that are minor but still laws (i.e. jay walking). I agree that being a cop can be stressful & they need to control their surroundings. I believe it was a subconscious thing for the cop, like he felt invaded more mentally than he did physically & hence the arrest.
If I was him, I would have put her in the car, driven around the neighborhood while giving her the lecture & then taken her back to her house, no need for anything else.
I really do think she will beat it in court.

Filming wasn't the issue... the arresting officer never told her to stop filming... her friend even picks up her camera and films her arrest... and (initially) she wasn't on her own property... see my post #89.
No one has the right to ignore instructions from police... especially not something as simple as "move back".
Ignoring instructions as simple as "calm down" is an arrestable offense in some states.
