I never understand why they do this garbage on interstate highways. I think it really is more about harassing innocent people rather than the safety bullshit that they say it is about.
If it really was about safety and getting drunks off the street they would set up their check points at the parking exit of popular bars and drinking establishments.
For me, it's all about getting a free chance to go through any random person's stuff because they are too ignorant and don't know their rights. How many arrests do you think they make because people don't know their rights? A LOT. And results mean more funding, etc., etc., etc. Not that far from ticket quotas. IMO.

This is a great piece on this. Basically, the kid was generally right (the cop even admitted that "he knew his rights" at the end). But that comment about his window being "OK" where it was is what pissed off the officer, heightened his suspicion, and turned it into the fiasco it was. That along with the, "am I being detained?" comment got the officer going. If he had rolled down his window and just answered the questions and indicated he did not want to surrender his rights not to be searched and just left it at that, the officer probably wouldn't have gotten his dik in a curl.
Officers can use just about anything they want to prove probable cause in something like this (to get you to pull over on the side of the road). You don't have to give up your rights, but you better know how to communicate them accurately to the officer or they will show you who is boss.
Sorry but individuals have the right to remain silent. The kid doesn't have to answer any questions. First and foremost, if you are ever in a situation like this you say nothing....whether you've been drinking or not. If you do say anything it should be I want my lawyer.

DUI check points are bullshït and they're unconstitutional. What's gonna stop them from making checkpoints to make sure nobody is driving without a license? Or without insurance? Or... what's to stop them from making checkpoints to make sure you don't have drugs on you?

You're right, he doesn't have to answer any questions. But he does have to communicate with the officer in regards to his position. Not opening his window just gives the officer more ammunition to make life difficult for the person.
I'm not sure what is wrong with opening your window all the way in order to communicate with the officer that you are not interested in answering any questions.
It's just like carrying a firearm in the open. Is it legal? In a lot of places yes. Is it a great idea? Probably not.
You can invoke your right to not answer any questions with a fully open window. Why do people feel the need to bait a cop?

Now when this kid gets pulled over for some minor traffic violation his chances of getting out of it are ZERO.
For as fast as this spread around the internet, you can bet that it spread throughout his local police force as well. Nothing like putting a bullseye on your back.

"Fuckin' Pigs" they would say when a cop would drive past without knowing that maybe that cop may have saved someone's life the night before or not. Funny thing is, whenever they were the victim of a crime, they were crying to the police faster than you could say Jack Robinson.
I guess we're just on different ends of the spectrum when it comes to the police force. I am one to respect what the police do(or try to do) and you just flat out hate them and feel their services are unnecessary. it is your right to not answer questions if there is not reasonable suspicion that you have committed a crime. The road checks per se are not illegal....but they have to allow you to exercise your rights if you choose to.
Honestly, Slovak, it is akin to an officer showing up at your home on a whim and asking you a lot of questions....and going through everything you own if they do not like the answers.
The old, "if you are not doing anything wrong, then what is the big deal," does not work for me.

So that tells me it's either one of two things that stopped you from you from enjoying your right to go out and have fun.
A.) you planned on driving home drunk which I doubt given your given you stance on personal responsibility.

B.) You were scared of what the cops could have done to you once they smelled the one or two beers you had consumed. You knew you weren't going to be over the limit, but still have the idealism that the cops could have f*cked you somehow. You shouldn't have to be scared into having to stay inside and that's where the problem lies. We do have the right to move freely without unreasonable search or questioning.

Not really Hutch. When you are driving on the public streets, you are on the State/Government's property, that is why they claim that driving is a "Privilege" because you are privileged to be using their streets and highways.
When you are at your home, you are on your property. Huge difference.
If someone loses control on the road because of poorly constructed or maintained road conditions(too much gravel, pot holes, etc) they sue the state.
If someone trips and fall on the sidewalk in front of your house because the sidewalk has lifted because of tree roots, they sue YOU. Even though you don't "own" the sidewalk, as a home owner, you are responsible for it, even though the public has every right to use it whenever they want.
And how did the government pay for those roads? With TAXPAYER money.
