Prediction markets are regulated at the federal level by the CFTC. However, that’s only half the story. Various states have taken legal action against prediction markets, arguing that they should be treated as gambling platforms and regulated as such.
For now, Texas Attorney General Ken Paxton has specifically spoken out about prediction markets, but he declared daily fantasy sports (DFS) illegal back in 2016 and doesn’t appear to have changed his stance on any form of gambling.
