Marvin Wilson has an IQ of 61 and is scheduled to be executed by lethal injection on Tuesday the 7th of August. I know very little about the specifics of this particular case, so I'm hoping that some of our COVERS members from Texas (or anybody else experienced in law and familiar with the case) can chime in here with an educated opinion.

That was a good post by Dtox, but I actually thought it was quite benevolent of the Texas Penal System to allow Granny Goose continued use of the internet in this circumstance and that they were kind in assessing his IQ.

Well, I was hoping to hear an educated discussion of why a retarded man, 9 IQ points lower than the State's own guideline for retardation, could possibly be executed.

This State executes FOUR TIMES as many convicts than any other State. Yes, you must take into consideration population size, but c'mon now. It's the year 2012 and they are still living the Wild, Wild, West. Executing retarded people, does it get any lower than that???

Im sure govenor perry will do the right thing... I mean he was a favorite at one time to be the presidential candidate...

I don't care if a person is insane or retarded, if they take another human life then they should be executed.
What I disagree with is a death penalty verdict if the state does not have both physical evidence and a credible eyewitness. The article mentioned he may not have been the shooter. The author doesn't go any further than that.
If the defense is arguing about this IQ test then I assume the evidence is overwhelmingly against the defendant. Otherwise they would be arguing the evidence/eyewitness angle.
Finally, the US Supreme Court recognizes the IQ test used and retardation, but each state is given autonomy when considering this. The state of Texas has determined he was smart enough to work in construction and father a child so he is not mentally retarded and can be executed.

the psych systems for people with chronic progression mental illnesses like schizophrenia, bi-polar and stuff like that and they either end up locked in the state hospital on meds or they are under strict supervision which if they dont comply with all requirements they go back to the hospital...
the developmentally delayed system is basically for anyone who scores 2 standard deviations from the mean IQ (100)... or on the aspergers autism spectrum..
but those are markers for determination of a psychological/developmental disability...
for the court case I believe the issue lies in the ability of the individual to aid and assist in their own defense...
