How could it possibly have to to with Obama's legal arguments when the policy he was referring to was announced (very recently) well after all briefs had been submitted and the oral arguments had been heard. It had no place in the decision and was clearly just Scalia's political opinion. While he verbally derides so-called judicial activism, he has become the most politically activist judge, maybe ever.

While he is a staunch conservative, and I disagree with a lot of his views on issues he is exceptionally brilliant. I remember he was going over a railroad case that was brought up in the supreme court about interstate railroad cargo and manufacturing. He really gives a great name to conservatives, however the ass clowns here, genuinely come off as hannity, o'reilly, and coulter regurgitators.
I'm not exactly sure you understand how smart the guy is. But I would like to hear what made you also believe he is brilliant.

He is by far the most personal Justice in some time, although I think Roberts will end up being as well.
