Really need impartial opinion on bet me and a friend made before NFL season.

ok i will try and make this as quick as i can.

Before the NFL season started me and a buddy were drunk talking a bunch of sh&t to eachother. He is a die hard Cowboys fan and im a die hard 49ers fan.

He said there is no way alex smith will win a super bowl before tony romo. So after going back and forth we finally agreed to a bet. He laid me 2-1 that tony romo would win a super bowl before alex smith. So his 2k vs my 1k.
 
As we were walking out of the bar i said i hope alex smith get traded tothe patriots and wins a ring backing up Tom Brady. He immediatley said no way that alex smith has to start and i called BS right away that we never agreed to that, we only said to win a superbowl. After some back and forth we both said whatever.

So here it is the most unusual thing that could have happened. The niners are in the superbowl with Kaep starting lol. He doesnt think he should be on the hook for the bet this year because alex smith is not starting. I believe he should be because if they win he still gets a ring and he started 8 games this year and i believe went 6-2 which he obviously helped them get there. We have no way to decide this without asking people who know neither of us. I have some really nice hedging possiblities if the bet is live. i can take the points with the ravens and hope niners win and dont cover to scoop.

Please give your input as to who you think is right in this situation.

This is y the specifics need to b clear on bets and witnesses should b present wit a 1k wager between a friend. Bets probably off. Why didnt u bet niners would win before cowboys?

Because this isn't a huge sum of money for us and it was him just talking crap about smith and me about romo.

This is def not bull garbage. And FYI a free roll for 1k with a chance at a 4pt middle for 3k is def the smarter play. It's not like 1k isn't a lot of money but he was implying that we needed witnesses. I guess I was just trying to say either way this is decided it wouldn't ruin our friendship. And why would I make this up? Just looking for honest opinions not people calling it bs.

ok well what if tony romo gets hurt mid way through the season and dallas wins a superbowl with kyle orton... would u n ur heart of hearts pay him or would u say that romo had to be the starter? i ask this cuz if u would honor the bet in the reverse the situation then i think he should too....

Yeah it's a tough one, I feel like I would honor the bet tho. I def understand where he is coming from but also Alex smith started half the games and help get us there IMO. Granted kaep took over but he still got us 6 wins. This is a really tough spot and If he is really adamant about not wanting to pay ill prob just drop it. He is coming back to town next week so we will be able to talk more about it then.

if he agrees that his exact words were "He said there is no way alex smith will win a super bowl before tony romo"... then he should pay the bet... he should have chosen his words more carefully...

if you sit on the bench all year and don't do garbage, but your team wins the Super Bowl... you get a SB ring...

good point by DaBest... should have said 49ers will win before Cowboys... and maybe the fact that you didn't say that is an argument in his favor...

No ones fault, but a poorly phrased bet. If your friend is arguing QB v QB for a superbowl win then IMHO the QB needs to be starting/playing in the superbowl. Just recieving a SB ring as a team participant is more of a technicality and you and your friend should have specified possible scenarios pre-flop. As you said with Smith being a back-up for Brady, you and your frind started to argue about the terms.

Even if the money is not an issue - it doesn't sound like it is a bet you should try and enforce with your friend.

Whatever arrangement you and your friend reach- I am confident that even if the 49ers don't in the superbowl this year, you still still will win because Romo is not winning a superbowl!!!

I think it's clear what your friend meant.

He meant, Smith playing, regardless if Smith won some games he did not win the SB, and that is clearly what he meant, he did not mean riding the bench or playing in some games he meant Smith winning the SB as-in the QB of the SB, unless Kap goes down early and Smith comes in and wins then I'd say it's a no-bet.

All drunk bets are null and void. People say stupid shit when they are drunk.

Regardless; it is clear exact parameters weren't set, so both sides can essentially argue he was right.

This is a voided bet because of both of these things, but mostly because drunk bets don't count. People said nonsense when they are into the sauce they don't mean.

Agreed, he clearly meant Smith starting.  To the OP you made 2 comments that lead to believe thats exactly what he was immplying.

The fact he brought it up that night should make this easy, but you called BS you say, well what was said after?  He obviously meant Alex Smith as a starter would not win.  I think you know what he meant.  If he never clarified and you intentionally conned your friend then your pretty much of POS.  So technically your right but you know damn well what he meant and if its your friend you let it slide unless Alex Smith plays even 1 play then you win.

I am sure this was immplying him as the starter also.  Once again sounds like you tried to con your friends with words knowing what he meant. 

yeah it was clear what he meant... winning a super bowl and being on a super bowl winning team is not the same..

Let it go....its not worth the fight, so the niners win and you look like a douche trying to collect.  I wouldn't want to take 1000$ of my friends money anyway
