Murder with a Depraved Mind occurs when a person is killed, without any premeditated design, by an act imminently dangerous to another and evincing a depraved mind showing no regard for human life.
The primary distinction between Premeditated First Degree Murder and Second Degree Murder with a Depraved Mind is that First Degree Murder requires a specific and premeditated intent to kill.
Manslaughter by Act: Committing an act that was neither excusable, nor justified that resulted in the death of another person.

The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life

I don't think because you're getting your @ss kicked, using a gun is a legit self defense argument. However I don't think "Kill that black hood rat" was his intent either ... when he was following Trey Trey. My vote is guilty - manslaughter ... ehhh something like 7 years, be outta jail in 2/3 years. That seems fair. Put me on that jury, I'll get this over lightening quick. No need for all the Scalabrine esque drama.

Funny how for over a year the media used the Skittles/Ice-T angle to try and make Trayvon sound so innocent when in fact he didn't even have Ice-T. He had some kind of Mellon Fruit Juice Drink that not only happens to go well with Skittles and over the counter cough suppressants, but Martin also talked about with friends on Facebook about mixing up.

Dorival: It's Good Neighborhood Watch practice to follow suspicious person from a distance
______________
Then why did Zimmerman end up where he did? And who cares if she loves Zimmerman. What matters is what happened when they got into the confrontation. And no one was there to witness it.

It's not, not at all..he's only using part of the transcript..The state asked if its advised to follow a suspect, and a firm answer of no was given. West..Zimmermans attorney has to be one of the worst speakers/trial lawyers I have ever seen. I have no clue why he is the mouthpiece for the defense.

I mean, it isn't as if the racial grievance people and the state have made a whole being deal out of Zimmerman following Martin or anything.
The person testified that it would be acceptable to follow Martin "at a safe distance." Zimmerman did NOT do that. He injected himself into the situation and confronted Marin. If anything, that proves that Zimmerman did NOT follow those "guidelines."
If I were the state, I would use this as evidence that Zimmerman was looking for trouble.
How is that brutal for the state?
Bottom line is, it wasn't illegal for Zimmerman to approach Martin (maybe not smart, but not illegal). All that matters is what happened when the confrontation occurred. However, if anything, this testimony is just going to be used by the prosecution to show that Zimmerman was the aggressor from the get go.
Brutal for the prosecution? Hardly. If anything, it helps.

All that matters regarding the law is whether or not Zimmerman reasonably feared imminent death or great bodily harm.
I agree. But I guarantee you the prosecution is going to use whatever they can to try and paint a picture of what Z's mindset was (ie. he was looking for trouble). The fact that he didn't stay at a safe distance and injected himself into the situation is part of that.
Remember, Z is the only one who can testify as exactly what happened at the scene. Everything else is just going to be based on the evidence (did Z pursue him....did Z initiate contact....were Z's injuries serious).
Trust me, the jury is going to take into account their perceptions of what Z's mindset was (ie. if they THINK he was looking for trouble based on the evidence).
