Actually, fairly poor reporting. Lots of mistakes. The case is: Martinez & Benitez v. Rozos where the Supreme Court ruled that the government cannot indefinitely detain “Mariel” Cubans and other noncitizen “parolees” who have final orders of deportation but cannot be deported because the country of origin will not accept their return. This ruling extended the rationale in Zadvydas v. Davis.

Non-deportation because of a crises in that country is completely normal.

The article makes it appear that the Obama order of non-deportation is why this person was released. That is playing hard and fast with facts. An illegal immigrant cannot be held pursuant to Clark v. Martinez & Benitez v. Rozos if the sole basis for detention is that status and the inability to deport. It would appear in this case that the illegal immigrant was released far too early for the crimes he had committed. That is mutually exclusive from detention based on status.

Our legal system sucks....if convicted of murdering 1+ should be automatic death penalty after 1st automatic appeal. Flatline after 30 days of that appeal.

Tell that to the dozens of death row inmates later shown to be innocent and released.

That has what to do with people being in the country illegally and committing murder??

Perhaps you should apply for an IRS job. "You'se pay taxes........so just give us all your money"

An excellent discussion of the facts.   Another reason why our prisons should be for thieves and violent offenders instead of people that need rehab.

An excellent discussion of the facts.   Another reason why our prisons should be for thieves and violent offenders instead of people that need rehab.

So you are OK with the state killing innocent people, as long as we don't spend too much money to keep people on death row?

Seriously?

Agreed.

We need true criminal justice reform but the problem is joe taxpayer(s) want nothing to do with the cost of actual reform, unless of course it involves no prison time for those with drug addictions. If that were to happen, we would have plenty of prison space for the real offenders.

yep its firearms

everyone knows that prohibition would have prevented these murders

every country that has outlawed firearms suffers no murders or violence caused by these nasty things

it has worked with alcohol in the past, its working with drugs now, hell its even working with immigration

just make things illegal and the problems go away

prohibition is the only answer

guns kill people, people dont

If you actually believe that nonsense you should consider talking to someone. That line of thinking is highly symptomatic of a serious dysfunction occurring between your ears.

Christ on a fucking Cracker you guys never cease to amaze me!

Gun laws? really?

Pretty sure it is Illegal to:
A) posess a firearm if you are in this country illegally
B) Murder people.
C) even be in the country.

The fact that your brain defaults automatically to gun control is a symptom of larger stupidity.
