Couple of instances off the top of my head as to why this would not suffice and why cops like to survey the situation:
1) Person has restraining order against him preventing him from being at "his" house due to divorce, beating his kids, whatever.
2) Criminals in house holding others hostage -- get rid of the cops and no one gets hurt...
3) This is a rental property that was recently broken into. Is this still the renter?
4) The front door did not lock due to forced entry (from earlier breakin) i.e. there was indication of a breakin (cop may not know if damage from prior instance or current, but how bad would it have sounded later if person was robbing the place and came out -- didn't you notice the door jam damage from forced entry?
5) Cop apologize for the inconvenience? It was Gates who appeared to be breaking into a house that caused the cop to have to respond. Gates should have apologized for wasting to cops time.
6) Cops provided name and number TWICE, only refusing on 3rd request when it was obvious Gates was not listening and only wanted to escalate matters.

My point was that there was no comment re: race in from Obama. If it was inferred, it was inferred because people view it as a racial statement.
There was no racial statement in the Willie Horton ads, and for the record, I have no problem with them. The racial issue was simply inferred by those that viewed it as such.

1) Why should the Sgt apologize for the inconvenience? A combination of astute/concerned neighbors and a jammed front door caused this inconvenience.
2) What better, more tacticly safe way to de-escalate a situation than to cuff the "antagonist", in front of his body no less, so as to minimize discomfort?
3)The cop AND the homeowner are both professionals in this case. The poor elderly black man (as I am reading it in some places) IS A HARVARD PROFESSOR! Responsibility and maturity should be exhibited on both sides to come to an amicable ending to this incident.

The best way to "de-escalate" a burglary investigation is to "detain" any possible suspectsin cuffs until facts come out that otherwise show no crime occurred.
Unfortunately Mr Gates chose to keep himself in cuffs with what this forum is calling "tumultuous behavior".
You are right.....most words are protected speech. But when you are straddling the fence with your actions where the officers can choose to dust you off, remove the cuffs and be on their way, Mr Gates chose to keep up his kindergarten verbal meltdown, thus giving the officers legal reason to turn the detention into an arrest.
Turning this issue into a question of legal arrest or not is missing the point of how this became a national topic. How about at some point America starts holding its citizens accountable to act with decency, maturity and respectibility.
Lets not forget Mr Gates was in control from the initial contact to determine how this interaction was going to go down. Too bad it is hard for most men to drop the testosterone level, talk normally and rationally and still be able to get your point across.
