that's a good point. normally, for the average guy, if the police think you are doing something wrong like this and it turns out you're not, they don't admit their mistake. that's what charges like disorderly conduct, resisting arrest, obstruction, etc. are for. police don't like to get into something and walk away empty handed.

my understanding is they were leaving and that he proceeded to follow them outside yelling at them at which point he was warned but decided to continue on with his rant at which point he was then arrested

Its better to be 100% sure that person lives there than to let him go based on an ID with an address on it. If this situation was a black cop and the victim was a white person I would still say 100% the cop made the correct decision.

while i would guess that both sides probably fucked this situation up (first gates and then the police), when the piolice decide they want to make one of these arrests, that report is going sound like they had every reason to make that arrest. polcie reports aren't as objective as we might like them to be.

The only facts in the Duke case that anyone needed to know was that the DA was an arrogant prick with a selfish agenda. Even from day one, that story didn't add up. Poor kids.
