Please fax your senators and remind them why millions of Americans oppose this amnesty! On September 27, Senate Majority Leader Harry Reid (D-Nev.) announced that the DREAM Act would not be considered as an amendment to H.R. 1585, the Defense Department authorization bill for fiscal year 2008. Supporters of this ill-conceived amnesty are not giving up, however, and this represents their latest attempt to pass the bill into law by attaching it to an appropriations bill. Tell Senate offices that the following things remain unchanged: - The DREAM Act allows illegal "teens" to petition for their parents, leading eventually to their aunts, uncles, grandparents and cousins: The big argument for this amnesty is that it is for teenagers who are here illegally because their parents broke the law. Even with the new "less-than-30" age requirement, far more than teens can get this amnesty (and Sen. Durbin has included "humanitarian" and "family unity" exceptions to the age limit). Nonetheless, the argument is that the teenagers should not be punished for the crimes of their parents. But as soon as DREAM amnesty citizens are over 21, they can bring in their parents who broke the law to get them into the country. The chief criminals will be rewarded after all. And because of Chain Migration, the amnestied "teens" can see their aunts, uncles, cousins and grandparents getting permanent U.S. residency as well. - The DREAM Act does not Protect Americans from Terrorists and Criminals: Illegal immigrants are not required to submit fingerprints or undergo background security checks at any point in the DREAM Act process. Therefore, The Department of Homeland Security (DHS) has no way to know whether an alien seeking DREAM Act amnesty is a terrorist or criminal. This security failure is compounded by the confidentiality section of the DREAM Act, which is a relic from pre-9/11 days (it’s modeled on the fraud-prone 1986 amnesty). This section basically requires DHS to hide information about terrorist and criminal aliens from itself. If a DHS adjudicator at USCIS learns from a DREAM Act application that an alien poses terrorist or criminal concerns, the adjudicator is prohibited from alerting ICE enforcement officers at DHS, and in fact, if the adjudicator were to volunteer such information to ICE, he could be fined $10,000. To cap it all, DHS is prohibited from removing from the United States all aliens, including criminals, terrorists, fraudsters, and other ineligible aliens while they have a DREAM Act application pending, even if that application is based upon fraud or the alien is ineligible. - The DREAM Act Offers Citizenship to Illegal Aliens Who Lack Good Moral Character: The DREAM Act does not require that aliens have a history of good moral character; it only requires that they have good moral character from the time that they apply. This means that criminal aliens, terrorists, and other aliens who lack good moral character before they apply get an amnesty for their pre-application period conduct, no matter how bad or extensive that conduct. - The DREAM Act is Not Just for Young People: Sponsors insist that the point of the DREAM Act is to provide legal status to “kids” and “young people.” However, the DREAM Act is not directed just at minors. Under the "new" DREAM Act, anyone 29 years old or younger, who illegally entered the United States before the age of 16 and has illegally remained here for 5 years or more will qualify for lawful permanent residence (and eventual citizenship) if they satisfy the easily-met criteria for DREAM Act amnesty. Illegal aliens who are 30-years-old or older can still be granted the DREAM amnesty through "humanitarian" or "family unity" waivers. - The DREAM Act is a Big Amnesty:

There are an estimated 2 million illegal immigrant children currently in the United States. They are only a portion of the millions of aliens who will likely qualify for the DREAM Act amnesty, because the DREAM Act does not place a cap on the number of people who qualify, provides exceptions to the newly-formed under-30 age limit, and applies retroactively to anyone who first entered before age 16. Furthermore, the recipients of the DREAM Act amnesty will be permitted to petition for their illegal parents and adult relatives once they become citizens. - The DREAM Act is Deceptive: The marketing campaign for the DREAM Act makes as though the amnesty is intended for high school graduates who are on their way to college or military service. But the bill as written ensures that illegal immigrants don’t have to attend high school or go to college to qualify for the amnesty: they need only take an ability-to-benefit test and complete a 1-year vocational program to get eventual citizenship (and there’s no requirement that they actually complete their college education). Nor do aliens have to join the Armed Forces: they need only go to work for the National Oceanic and Atmospheric Administration or Public Health Service for 2 years to get eventual citizenship. - The DREAM Act is a Fraud Machine: We know from experience that amnesty from immigration laws generates massive fraud, and the DREAM Act is no exception. Nothing in the DREAM Act will prevent a 29-year old alien from asserting that he entered the United States before the age of 16 and has remained here ever since. The DREAM Act is silent on how DHS will determine the veracity of such claims. The DREAM Act will actually promote fraud because it prevents DHS from deporting aliens who’ve applied for the amnesty until their applications are resolved – a process that will likely take years, because DHS lacks the resources to rapidly process the millions of applications it will receive. Even if DHS eventually decides that some aliens do not qualify for the amnesty, DHS cannot use the statements aliens made in their applications to deport them, because their statements are protected by the confidentiality section in the DREAM Act. - The DREAM Act is Unfair to American Students and Taxpayers: The "new" DREAM Act removed the in-state college tuition section. However, aliens who get the amnesty will become legal residents and will therefore be automatically eligible for in-state tuition anyway. - The DREAM Act Puts Illegal Immigrants at the Front of the Line for Green Cards: The DREAM Act requires that applications for its amnesty must be expedited, bars DHS from charging fees for expedited service, and fails to provide DHS the additional personnel and equipment needed to handle expedited applications. Because millions of people will file applications for DREAM Act amnesty (regardless of whether or not they eventually qualify), DHS will experience a significant backlog of cases that will necessarily slow DHS’ ability to process conventional business and family visas, and applications for naturalization. This will adversely impact our economy, and disrupt the settled expectations of intending legal immigrants to the United States. - The DREAM Act Will Allow Dangerous Criminal Aliens to Remain At Large in the United States: DHS lacks the resources to detain all criminal aliens it encounters in the United States, and so DHS has to pick and choose which criminals to hold for deportation. When DHS deports a criminal al ien, the detention or “bed space” vacated by the out-going criminal is immediately filled by another criminal alien. The DREAM Act does not disqualify anyone (even criminals) from filing an application and bars DHS from removing any alien who’s filed an application for amnesty. Thus, criminal aliens who have no desire to be deported will file DREAM Act applications to halt or slow their deportations, which means they will spend more time taking up detention space which could be used to house other criminal aliens. That means more criminal aliens whom DHS cannot house will be free to roam the United States. The DREAM Act also creates an opportunity for extremely dangerous criminal aliens to be released into the general population. By law, a criminal alien who is subject to a final order of removal must be released from DHS custody within 90 days if his removal is not “reasonably foreseeable.” As mentioned previously, the DREAM Act does not allocate resources to DHS to process the millions of applications that are sure to be filed, which will result in very lengthy delays. The result? A dangerous criminal alien who would otherwise have been removed from the United States files his DREAM Act application, and when that application stalls at DHS with millions of others, he can file a petition in a district court after 90 days to effect his release because his removal is not “reasonably foreseeable.” https://numbersusa.com/video

Senate Majority Leader Indicates He May Bring Stand-Alone DREAM Amnesty To Vote Later This Week Here is the scariest news yet: Senate Majority Leader Harry Reid (D-Nev.) has invoked Rule 14 on the new stand-alone DREAM Act amnesty! That means he is setting up Senate procedure to spring the amnesty at any time without hearings or committee action. For the Majority Leader to invoke Rule 14 means that he can bring a bill to a floor without it going through the debate and markup of a committee. Rosemary Jenks, our NumbersUSA Director of Government Relations, says, "Generally when Rule 14 is invoked, it means the leadership intends to have a vote on the bill in fairly short order." Under the rule, the amnesty bill (S. 2205) can be brought up as early as Tuesday. The rule also allows Sen. Senate MINORITY Leader McConnell Giving Us Hope One of the great things we have working for our anti-amnesty efforts this time is that Sen. Mitch McConnell (R-Ky.) is working assertively on our side. During the fight over the Comprehensive Amnesty last spring, the Republican Senate leader took a mostly neutral stance until he cast his NO vote at the end. But this fall he is providing strong leadership behind the scenes to stop the DREAM amnesty. If he can hold 41 of his 49 Republicans, he could defeat the DREAM amnesty without any help from Democrats. In June, 12 Republicans defected to the open borders side, leaving just 37 Republicans voting NO and requiring at least four Democrats to defeat the amnesty. Fortunately, 15 Democrats and one left-leaning Independent also voted NO. McConnell's assertive leadership against rewarding illegal aliens and encouraging an even larger run on the border gives us hope that more than 37 Republicans will vote NO this time. We have seen strong signs that several of the 12 pro-amnesty Republicans of last June are extremely skittish about further inviting the ire of their constituents with another YES vote on amnesty. On the other hand, some of last June's Republican NO voters are telling the open-borders lobbies that they see the DREAM Act as a palatable amnesty since it is mainly for teenagers. On the Democratic side, we are not at all optimistic about keeping all or most of the 15 NO voters from June on the anti-amnesty side. They are being swayed that this is a very different kind of amnesty that they can sell to voters as a pro-child vote. It appears that we might be in for a very pleasant surprise. * * * * * * * The rabidly anti-immigration website NumbersUSA (the main vehicle for the antis to influence Congress) has gone on a war against DREAM, and despite its best efforts for a week now, has managed to get only 22 Senators to publicly commit to voting against DREAM (they would need 41 votes to prevail). Mr. Durbin, in response to NumbersUSA's ferocious campaign has made two minor modifications to his original language, showing that most of the votes for DREAM appear to be there. It is our estimate that DREAM would garner about 70 votes on the floor if a showdown came at this time. So much for the good news. Now for the rest. Senators who are eager to enact DREAM say that they are getting calls against it by lopsided ratios of 50 against to 1 for. Even a small number of calls and faxes by those in favor would help them better justify a vote against the concerted effort by the antis to bully Congress into a position where voting for benefits becomes impossible. Here's why everyone who wants immigration benefits, of whatever kind, should care about DREAM. If DREAM succeeds on the Senate floor, there is a whole slew of benefit bills lined up right behind it - SKIL, AgJOBS, you name it. We believe that once the benefits dam breaks in Congress, a flood of benefits will follow. Our best read of the House at this time is that the House Democratic leadership will permit a vote on any immigration benefits to come from the Senate, and we believe that there are plenty of votes on the House floor for targeted benefits like DREAM, SKIL and AgJOBS, etc. That is why DREAM is worth pushing for, even apart from its intrinsic merit, since a veritable cornucopia of benefits may well result in the wake of its success. We urge our readers to support (and get others to support) DREAM through faxes and calls to the Senate. I emphasize to you that the text above in blue is from the pro-amnesty publication Immigration Daily. The Coalition for Comprehensive Immigration Reform (CCIR) is another entity working full-time against your interests and for outlaw employers and their illegal workers. Its recent assessment of the situation is this: Strong grassroots rally by “anti-immigration” groups scared away some Senators who were considering DREAM The CCIR has isolated “the myths and lies” which are the arguments against the Dream Act, and is better prepared to debate it Pro-amnesty activists find they do best when calling Senate offices by emphasizing that it is for children who have come to the US and stayed in school, and “stayed out of trouble.” Pro-amnesty activists are advised to never refer to the illegal teenagers as 'undocumented students” without adding “…who have grown up here.” People will react better. “We feel really good about the people sitting on the fence. They (the opposition) had to go all out on the blogs and phones in order to beat us, and they just made it.” With a stand-alone bill, the fence-sitters ought to come back to the amnesty side. Some key Republican Senators who have been telling their constituents they will vote NO on DREAM attached to any spending bill are telling CCIR that they plan to vote YES if DREAM is a stand-alone. S. 2205 provides for no extra enforcement to help ensure that families around the world don't risk their teenagers' lives by forcing them to enter the U.S. illegally across the deserts. Passage of this amnesty likely would increase deaths of illegal aliens in the desert as more and more people attempt to get into the country in preparation for the next amnesty. Many of the advocacy groups pushing the DREAM Act amnesty openly say it is intended as a way to break the barrier and then to push for several more amnesties and rewards for illegal aliens. Many of these teenagers weren't brought to the United States illegally by their parents. Rather, many of them came on their own and found illegal shelter with legal immigrants who were from their country. He is fighting for immigration rationality and the rule of law with the kind of winning confidence he showed in college when he was runnerup for the Heisman Trophy. We believe this bill with its bi-partisan support but originating on the Democratic side of the House is just the vehicle to give us a chance to actually pass immigration legislation through a Democratic-controlled Congress that would significantly improve the lives of most Americans. REQUIRES EVERY EMPLOYER TO USE ELECTRONIC VERIFICATION SYSTEM ON EVERY EMPLOYEE The SAVE Act does a lot of things to protect our borders and to help with interior enforcement. (We'll provide you with a section-by-section analysis as soon as the bill is formally introduced.) But the section that I applaud the most has to do with workplace verification. We believe that jobs are the main reason illegal aliens come here. Drying them up would seriously slow the flow of new illegal aliens. And it would start to drive perhaps as many as a million already-settled illegal aliens back home each year. The SAVE Act would eventually require every employee in America to go through the E-Verify system. This internet system provides employers with an inexpensive, quick, and accurate way to verify that employees are not illegal aliens. The rules for use are such that no employee or employer suffers if there is a mistake in the system because there is ample time to correct errors on the employee's side and on the government's side. The SAVE Act would ... ... require during Year 1 that all government agencies, government contractors, plus all businesses with more than 250 employees run all NEW hires through E-Verify. ... require during Year 2 that all businesses with 100 or more employees use E-Verify for new hires. ... require during Year 3 that all businesses with more than 20 employees use E-Verify for new hires. ... during Year 4 add businesses with fewer than 20 employees so that all businesses use E-Verify for new hires. ... also during Year 4 require all businessese to run all their previous hires through E-Verify. The four-year phase-in is to give the government more room for massive expansion of its current system. It also allows the government to work out kinks before it is required for use by small businesses which often lack the personnel to easily deal with new procedures. During the first three years, new illegal aliens and currently settled ones who lose their jobs will find fewer and fewer places where they can seek work. But during those first three years, current illegal aliens who stayed in the same job would not be affected by the expanding use of E-Verify. In the fourth year, however, all of those illegal workers would be run through E-Verify. If their Social Security number, name and a couple more details didn't match -- and they had no excuse -- they would lose their jobs. NumbersUSA has always maintained that very few businesses actually want to hire illegal aliens. And we believe that of the minority of businesses that do hire illegal aliens, most do so without knowing it or do so because they feel forced to do it to keep from being run out of business by competitors who ARE hiring illegal aliens. If we give businesses a tool they can rely on, and assure them that their competitors won't get by with hiring illegals, very few illegal aliens will get hired anywhere. There aren't enough odd-jobs and off-the-books jobs in the underground economy to soak up the estimated 7 million illegal workers in the country. Most illegal aliens will no longer find enough work to support them and their dependents, and most of them will eventually give up their lives of illegality and go home -- ATTRITION THROUGH ENFORCEMENT & SELF-DEPORTATION. FIRST-TIME PROVISIONS TO CATCH ILLEGAL ALIENS USING IDENTITY THEFT All of us inside and outside government who have lauded E-Verify under its different names the last decade have acknowledged that it doesn't identify all illegal aliens. It works with the majority of illegal aliens who are making up Social Security numbers and names when they apply for a job. But if an illegal alien has paid the money to steal the identity of an American, or a legally present foreign national, E-Verify passes them through. The Shuler bill is the first to address this problem and solve it. It creates a system of detecting when the same identity is being used to hold down more jobs than are credible. In some cases, the same identity is being used by hundreds of people in hundreds of workplaces. The Shuler bill creates a notification system that roots out this fraud. We'll describe this in more detail in a later alert.

A CHANCE FOR HOUSE DEMOCRATS TO STAND ON SIDE OF AMERICAN WORKERS -- AND AGAINST OUTLAW COMPANIES HIRING ILLEGAL ALIENS We are ecstatic to see so many Democrats considering signing on to the toughest workplace verification language ever proposed in Congress. In the Senate, the Democrats are overwhelmingly leaders for open borders and providing unscrupulous businesses with massive flows of foreign labor. But Shuler is out to prove that Democrats in the U.S. House stand by American workers. I'm making such a big deal about this bill because many commentators since Democrats took control of Congress last November have said it will be impossible to move an enforcement-only bill any sooner than 2009. If we are to have any chance at all, the vehicle must be a Democratic vehicle. The SAVE Act is. But we need your help to push your Democratic Representative (if you have one) to sign up. BIGGEST ANTI-ILLEGAL IMMIGRATION GROUPS ENDORSE 'SAVE ACT' After weeks of study of the SAVE Act, NumbersUSA on Monday issued its official endorsement. Rep. SENATE AG CHAIRMAN STRONGLY OPPOSES ANY VOTE ON AgJOBS AMNESTY ON HIS FARM BILL NEXT WEEK Chances of a giant amnesty for ag workers and their dependents diminished significantly this morning at the National Press Club. Sen. Harkin (D-Iowa), chairman of the Senate Agriculture Committee, told a group of reporters that he is adamently opposed to the Democratic leadership allowing the AgJOBS amnesty to be introduced as an amendment to "his" Farm Spending Bill. Harkin noted that he is an original co-sponsor for the amnesty for illegal aliens working in agriculture. But he said immigration should not be legislated in the Farm Bill. In fact, he said, immigration policy should not be taken up again until after "the next election." That would be 2009!
