I'm wondering if it might be a bigger story or if there will be more backlash for this case than the others because it happened under the 'hated' Bush administration, and more importantly, in the USA.
If you look at the *update* at the bottom of the article where they specifically outline what legally constitues 'aiding' terrorist organizations, there is no way around it. This is black and white.
Also, letting the Bush administration off the hook is directly responsible for allowing the Obama administration to get away with the same type of garbage. If Bush hadn't gotten carte blanche immunity on Day 1 of the Obama presidency, this wouldn't be allowed to keep happening because there would be a clear sign that this is not acceptable. It sends the message that there are real consequences for such immoral and illegal actions. Not even, it would be proof there are consequences and might make whatever POTUS think twice about what illegal actions he orders people to do.
If you want to stop this type of thing from happening in the future, you have to hold these people accountable, especially if laws were broken. Which is the case here.
Otherwise, what's to stop Obama or the next president from committing war crimes or something similar. There is no incentive to follow the law, and more importantly there is no deterrent for illegal actions if everybody knows in advance there will be no consequences.
You end up with the potential for drone attacks on god knows who, and the DOJ explaining how it's OK for them to decide which people they should be allowed to kill or imprison without trial.
This is a big issue.
