I good friend of mine and a co-worker who had been at the company for more than 20 years just got fired for making a joke of a sexual nature to another employee. My friend is known as a big time jokester and overall good-guy. He got along with everyone at work and was a very popular person in the company. He told another employee that they have "a nice ass". And get this, the other employee was also a male.
I wasn't present at the time of this incident, but this is what I was told how this went down. My buddy was sitting at his desk and the other employee (a new maintenance employee) was to his right, with both knees and body on top of the desk fixing a key locker box that was hanging on the wall. The desk in the office is one of those long counter desk that fits on three sides of the wall. So my friend turns to his right to get up out of his seat, and his face comes within inches of the maintenance guys butt. So he blurts out "nice ass" and continues on his business.
To make a long story short. The maintenance worker didn't take to kind to being told he has "a nice ass" and reported the incident to HR. The maint man threatened to sue the company if they didn't take action. The company asked the maint worker if he would accept a personal apology from my friend and he said no, fire him or else.
So the company fired my friend to avoid going through a legal battle. I think what also made the company's decision to let my friend go a little easier was that he was on notice for poor performance already and the fact that we are down sizing to consolidate two companies into one.
So was this firing justified? It was his only incident of sexual harassment. The only way the company said he could get his job back is if the union went balls to the wall for him. And I seriously doubt that cause we have a weak ass union. The lesson here I guess is don't joke around with people you don't know.

Another factor may have been that they maintenance worker was intimidated by my friends presence. After all my buddy is a 6' 4" 260lb black man and the maint worker is about a 5' 6" latino about 165lbs. Niether my friend, myself or anyone else thinks this incident had anything to do with race. It was a case of you can't kid around with people you don't know, and my buddy got burned. He will survive.

No WAY the company had to terminate this person. The main thing for a minor incident like this is to ensure nothing further happens in the future. It's not like it was an overt physical act or a repetitive verbal barrage which created a hostile environment.

Assuming this is the whole story, he'll get put back to work by the arbitrator; and, if the company was my client, I'd tell them to put him back in now - no sense just making him whloe later - with a "last chance" sort of warning.
