This lady was originally sentenced to 12 years as a first time offender. She got another 2 years added for ultra-stupidity and then later a judge knocked off 4 years.
This article from the same neck of the woods about a crime committed just 6 months prior.
To summarize, a twice previous DUI offender killed 2 people on her third offense. She was sentenced to 12 years for each count of manslaughter (consecutive). Since that is the punishment handed down then it must also be correct.
So according to the sentencing guidelines in Oklahoma, getting caught selling marijuana the first time is the equivalent of getting intoxicated and killing 1 person on a third DUI offense.
Yes, as it stands selling marijuana is illegal and if caught the offender must deal with the consequences. However, do you really believe that 12 years in this case is appropriate for the crime?
If it was your (and yours alone) responsibility to set sentences for all crimes, are you saying you would assign 12 years to this? If so, then what would you set for the manslaughter case referenced above?

I would agree that 10 years seems extreme for a first time offender convicted of selling marijuana. However, I am having trouble finding sympathy for a person that carries marijuana into booking after being sentenced for a drug conviction.
Yes indeed. But stupidity is not a crime. This story is a perfect example of stupidity though... on the part of the justice system.
For her to get sentenced for 10 years is a crime in and of itself. |

Drug dealers get a higher sentence, end of story.
Lots of better things to do with life than to sell or smoke pot recreationally.
Wallstreet... the punishment has to fit the crime. You can't put somebody behind bars for 10 years for selling $31 worth of marijuana. You just can't do that.
The people responsible for deciding and implementing this sentence should be put behind bars for 10 years. |
