LOL, I am nor sure about that punishment, but the one thing that sticks is out is, he apparently thought their were thieves in his bathroom.
He supposedly shouted out, something to them before he opened fire. If that was the case, don't you think his girlfriend would have said something like "its me, what are you talking about"....
Even after the first shot, she would have screamed, yet he just kept on shooting?
He is guilty as can be.
For some reason, I have a feeling he will get a light sentence.

Suppose you were asleep in your room with your partner and its pitch black, lets say you hear something in your bathroom...don't you double check to see if it is your partner first? Wouldn't you give your partner in bed a nudge first or speak to her?
If she isn't in your bed, wouldn't you shout "who is there"? If it is your partner in the room, wouldn't she reply back, "its me"?
He is guilty as anything.

The smart thing to do is get into a defensive position and THEN think about asking the question....IF you can (sounds like he could have). But just shouting out, "who's there?" can get someone killed if the bad guy has your gal at gunpoint in the bathroom or if they have a gun on you.
The first thing you do is assess the situation, not yell out. It sounds like he had the opportunity to get his gun and make a decision.
I personally think he is guilty as anything, but you have to think about what you would do before this kind of stuff happens.

So if you aren't sure either way, just start firing away in your own home?
He actually asked who is it or get out or something of that matter.

Sure, but when you wake up , you are in bed...wouldn't you feel for your partner first?

He shouted out 3 times at the bathroom and their was no answer. We know for a fact she was in the bathroom, if your partner is in the bathroom and you shout 3 times in the middle of the night at the bathroom door, wouldn't your partner say " uhm, its me, what are you talking about" sort of thing?
She would have heard his screaming as he claimed to heard something from the bathroom, so the walls are not sound proof.
That is the biggest hole in the story imo.

If I hear a noise in the bathroom or any other rooms in the house, my first instinct is to look next to me to see if my gal is there or not. If my gal is not there, then it's more than likely her that is making the noise. If she is there next to me in bed, then it might be a burglar. This tragic incident was easily avoidable had he just do a simple thing by checking to see if she was next to him. Also, why did he think a burglar was in the bathroom?? The burglar was trying to steal toilet paper? If I am robbing a house, the last place I would go is the bathroom...or never go there at all.
The best punishment would be to take away his prostethics and let him crawl on his stumps for life.
